These Terms & Conditions ("Terms") govern your access to and use of Aisha, an AI-powered WhatsApp assistant operated by The Tech Hut ("The Tech Hut", "we", "us", or "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Aisha connects to your WhatsApp number and uses artificial intelligence to reply to your customers, answer questions from a catalog you provide, calculate order totals, generate payment links, follow up with customers, and help you track payments and shipping. The Service is provided on a subscription basis and is intended for business use by the account holder.

The replies Aisha sends are produced by automated AI systems and may contain errors. You are responsible for reviewing the Service's activity and can disable auto-reply or take over any conversation at any time.

2. Eligibility & accounts

  • You must be at least 18 years old and able to enter into a binding contract.
  • You must provide accurate account information and keep it up to date.
  • You are responsible for all activity under your account and for keeping your login credentials secure. Notify us promptly of any unauthorised use.
  • You must own, or be authorised to manage, the WhatsApp number and business you connect.

3. Subscriptions & billing

  • Access to Aisha requires an active paid subscription. Plans and prices are shown on our pricing page and are billed in Kenyan Shillings (KES) on a recurring monthly basis.
  • Subscription payments are processed by our third-party payment provider, Paystack. By subscribing, you authorise us (through Paystack) to charge the applicable recurring fee.
  • Fees are non-refundable except where required by law. Cancelling stops future renewals; it does not refund the current billing period, and you keep access until the period ends.
  • We may change plan features or pricing. We will give reasonable notice of price changes, which take effect from your next billing cycle.

4. Payments collected from your customers

Aisha can generate payment links so your customers can pay you. Depending on your setup, these payments are collected into a central account operated by The Tech Hut (via Paystack or M-Pesa) and made available to you as a wallet balance, which you may withdraw to your M-Pesa number — manually or automatically. If you connect your own Stripe account, those payments settle directly to you.

  • You are solely responsible for the goods and services you sell, for fulfilling orders, and for any taxes, refunds, chargebacks, or disputes arising from your sales.
  • Payout and withdrawal timing depends on settlement by the underlying payment providers and may be delayed by verification, insufficient settled balance, or provider outages. We do not guarantee instant availability of funds.
  • We are not a bank and do not provide financial, money-remittance, or escrow services. We simply facilitate collection and payout through licensed third-party providers.

5. WhatsApp & third-party services

Aisha is an independent product. It is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. "WhatsApp" is a trademark of its respective owner. Your use of WhatsApp remains subject to WhatsApp's own terms, and you are responsible for complying with them. Automated messaging may carry a risk of account restriction by WhatsApp, which we cannot control or be liable for.

The Service relies on third-party providers, including Anthropic (AI), Paystack and Intasend (payments), and the WhatsApp platform. Your use of the Service is also subject to those providers' terms, and we are not responsible for their acts, omissions, or availability.

6. Acceptable use

You agree not to use the Service to:

  • break any applicable law, or sell illegal, counterfeit, or prohibited goods or services;
  • send spam, or message people who have not consented to hear from your business;
  • deceive customers, misrepresent prices or products, or process fraudulent or unauthorised payments;
  • infringe anyone's intellectual-property or privacy rights, or upload unlawful, harmful, or abusive content;
  • interfere with, reverse-engineer, overload, or attempt to gain unauthorised access to the Service or its systems.

We may suspend or terminate accounts that violate this section.

7. Your content & data

You retain ownership of your catalog, messages, customer information, and other content you provide ("Your Content"). You grant us a limited licence to process Your Content solely to operate and improve the Service. You are responsible for having the necessary rights and consents to the customer data you handle through the Service, and for complying with applicable data-protection laws, including Kenya's Data Protection Act, 2019.

8. Intellectual property

The Service, including its software, design, and branding, is owned by The Tech Hut and its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your business during your subscription. You may not copy, resell, or create derivative works from the Service.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate, complete, or suitable for any particular customer or transaction.

10. Limitation of liability

To the maximum extent permitted by law, The Tech Hut will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount of subscription fees you paid to us in the three (3) months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless The Tech Hut from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, the goods or services you sell, Your Content, or your breach of these Terms or any law.

12. Termination

You may cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us, our providers, or others. On termination, your right to use the Service ends; sections that by their nature should survive (including payment obligations, disclaimers, and limitations of liability) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts of Kenya.
